HC fumes at ‘disobeying’ of court orders, warns top official of contempt

Srinagar: ‘Everything has a limit,’ an exasperated J&K High Court told government authorities on Wednesday while warning of contempt of court.
Justice Ali Mohammad Magrey recorded that the Health and Medical Education Department had failed to implement court orders passed four years ago in a service matter. The court directed the Financial Commissioner of the department to appear in person before the court to explain why the court orders had not been implemented.
Justice Magrey said that confidence of the general public in the judicial system for ensuring protection of the rights of people is of utmost priority for the court.
“Liberal approach adopted in seeking implementation of the judgement must not be construed as a concession and the people at the helm of affairs must not feel encouraged in disobeying/ delaying the implementation of the court orders or taking them casually,” Justice Magrey noted.
“The court cannot all along wait for the respondents to wake up from the slumber and report compliance,” Justice Magrey said.
Before proceeding further in the matter, the judge said, “It is proper to hear the Financial Commissioner, Health and Medical education department, in person as the court is prima facie satisfied that the respondents have committed the contempt of court by delaying the implementation of the judgement.”
In 2016, the court had directed authorities to regularise petitioner Dr Nowshaba in her services as dental surgeon by reckoning the period of service from 1996 to 2003 and then from 2008 onwards.
