High Court dismisses petition challenging Mian Qayoom’s PSA detention

Srinagar: The J&K High Court on Friday dismissed the petition challenging Public Safety Act (PSA) detention of Jammu and Kashmir Bar Association president Mian Abdul Qayoom.
The court of Justice Tashi Rabstan while dismissing the plea held that the grounds of detention are precise, pertinent, proximate and relevant.
While giving references to Supreme Court verdicts recorded in the order, the court said that the matter lies within the competence of Advisory Board. This court doesn’t sit in appeal over decision of detaining authority and cannot substitute its own opinion, it said.
“For the foregoing reasons, the petition sans any merit and is accordingly dismissed,” Justice Tashi said.
The petition filed by the Bar Association in the High Court’s Srinagar Wing in August challenged the detention on the grounds “the detention is not in consonance of law as the detenue has been arrested under the activities which was registered against him in 2008 and 2010.”
It is fifth time when Qayoom has been arrested under Public Safety Act.
“There is no fresh activity attributed. A person has been detained on previous activities for which he was already punished and after almost 10 years has passed he is being detained on the same ground. This is travesty of Justice,” Advocate Shaheen told Kashmir Reader.
“We will challenge this judgement for sure,” he added.
