Govt violates own rules, posts IPS officer against reserved post of the JKPS

State government has violated its own order by posting the IPS officer against the post which has been reserved for the Jammu and Kashmir Police Service cadre.

State’s home department posted Sham Lal Sharma, IPS officer of 1996 cadre, from the IGP PHQ to IGP State Human Right Commission (SHRC), on deputation basis. The order came only a day after government ordered the creation of the KPS cadre as per which the post of IGP SHRC will be redesignated and reserved for the JKPS cadre.

The government has renamed the Kashmir police service (KPS) as Jammu and Kashmir Police Service (JKPS) now after coming under pressure from the BJP. As per the cadre review order which was issued by the Home department the post of IGP human rights will be reserved for the officers in the super time scale II who will have the grade pay of Rs 10,000.

However, a day before the government finalized the cadre of the police by drawing up seven cadres of the JKPS including the general cadre, the government posted IGP Sham Lal Sharma as the new IGP SHRC. Top sources in the government said that the post was vacant for nearly 10 months and falls in the deputation reserve.

“The post is the deputation post of Law department and Sharma has been posted on deputation,’’ said an official.  As per the government orderno.654-home of 2017 dated 8 June 2017 it has been ordered that “in the interest of administration’’ Sham Lal Sharma was transferred on deputation basis.  The decision has further left the local cadre police officers miffed who have termed the decision as “ a mockery’’ of government’s own rules.

It has been after the consistent demand from the local officers that the cadre review was ordered. A top home department official said that the KPS cadre review will take time to be finalized as they will have to work out the new police service rules. As per the new KPS cadre order the post of IGP Human Rights and the IGP Civil Military Liaison which fall in the super time scale II as the posts of the four DIGs in the super time scale I with the grade pay of Rs 8,900 will be redesignated and reserved by the local cadre police officers.

“There are some isolated posts which are not coming under police like the IGP human rights which are on deputation. The police rules will be amended which will be done by a committee comprising officers from the Law department, General Administration department (GAD) and Home department,’’ said an official.
