Srinagar: The J&K High Court directed the government to strictly enforce prohibition on sale and usage of polythene in the entire Jammu, Kashmir and Ladakh especially at tourist destinations.
The court of Chief Justice Gita Mittal and Justice Puneet Gupta recorded that in Jammu & Kashmir and Ladakh is an ecologically fragile area especially the tourism spots and the prohibition on polythene is required to be strictly enforced.
“It is essential that the respondents give due publicity of the prohibition and apprise all vehicle owners and the public at large about the legal position,” the court said.
The court issued direction to the Home Department, J&K State Pollution Control Board, Tourism Department, Floriculture Department, Environment and Forest Department and Housing and Urban Development Department to prepare proper publicity material which shall be posted in the electronic / print media as well as displayed on signages at all prominent places in Jammu & Kashmir and Ladakh.
The court said the public at large must be notified regarding the prohibitions and disclosing the liabilities which shall flow to the vehicle/owners for carrying such prohibited material including the financial liabilities/fines.
“An action taken report shall be filed by the respondents before the next date of hearing,” the court directed.
The court also directed that the copy of the order be served on Secretaries, Home Department, Housing and Urban Development Department, Tourism Department, Environment and Forest Department, J&K State Pollution Control Board, Floriculture Department and all Development Authorities including the Srinagar / Jammu Development Authorities, Pahalgam Development Authority, Gulmarg Development Authority, Sonamarg Development Authority, Patnitop Development Authority.
The court will again hear the matter on November 10.
