Court holds JK excise commissioner guilty of contempt

Jammu: A trial court at Jammu on Monday declared Rajesh Kumar Shavan, Excise Commissioner, J&K as ‘wilful’ contemnor of court orders while directing him to surrender before court on 14 October failing which he will be arrested through required warrants.
The court of Virinder Singh Bhou, 2nd Additional Judge, Jammu while pronouncing the judgement in a contempt petition held the official, Rajesh Kumar Shavan for violation of court orders.
The Judge recorded that the Contemnor has acted and is continuing to act in blatant, wilful, culpable and continuing violation and breach of the court order dated 4 July, 2020 wherein court had directed him to give Transport permission to petitioners who have liquor vending business and are proper license holders.
The court noted that despite order having passed more than fifty days, the officials are acting ‘blatant’ despite directives from the High Court to comply with trial court order dated 4 July, 2020.
The petitioners, according to them, from the last two months are without any work and have been left handicapped by the sluggish approach of the higher officers of the Excise department.
This court is left with no other option except to subject Contemnor to suffer Civil imprisonment and “accordingly the contemnor is guilty of acting in disobedience of the court order for which he shall suffer civil imprisonment,” court ordered.
“File be put on 14 October for announcement of term of Civil imprisonment to be suffered by the contemnor and payment of expenses of detention by the petitioners,” court said
