SHRC pulls up Govt, directs it to pay 5 lakh to disabled PDD daily wager

 

The State Human Rights Commission (SHRC) Jammu and Kashmir Wednesday asked the state dispensation to pay Rs 5 Lakh to a Power Development Department (PDD) daily wager who got disabled due to a power shock while repairing a faulty transmission line.

A case titled Dr. Linen, General Secretary Manavadhikar Jan Nigarini Samiti SA 4/2-A Daulatpur Varansi Utter Pradesh filed on behalf of one Muneer Hussain S/O Mohammad Shafi R/0 Noona Mandi Poonch working as daily wager in Power Development Department who while repairing a fault lost his left arm by way of amputation at GMC Jammu. The case was listed before the SHRC Member Jung Bahadur Singh Jamwal.

After going through the material available the member observed that Prima-facie, it appears to be gross violation of human rights as the victim has become permanently disabled and will holly and solely be dependent on others for support of his daily livings.

While disposing of the matter, SHRC recommended a compensation of Rs. Rs,5.00 lakh (Rupees Five Lakh) to be paid to the victim and deduct Rs.55000/- (Rupees fifty five thousand) from the recommended compensation which the victim had already received.

The amount recommended can be borne by Power Development Department. Besides, the services of the victim be regularized if already not done, the SHRC observed.

The Chief Secretary was also directed to issue orders to the Power Development Department to pay Rs.5 lakh to the complainant (victim) and implement the judgement in letter and spirit.

Notwithstanding the fact, Chief Engineer Maintenance & R.E. Wing Jammu is also directed to initiate the process for payment of the compensation to the victim for causing his disability due to negligence of the concerned officers/officials and to recommend the action against the then Lineman Abdul Rehman and the then erring Officers/officials of the concerned Division/Sub Division of PDD of the area to show cause why this compensation should not be borne by them and further recommend a disciplinary action against all of them for dereliction of their duties.
