PAMPORE: In a significant step towards promoting restorative justice, the Court of Munsiff/Judicial Magistrate Pampore has convicted an accused under Section 355 of the Bharatiya Nyaya Sanhita, 2023, and directed him to undergo community service for a period of one month.
The case, titled UT of J&K vs. Bilal Ahmad Gojri, arose from a complaint highlighting repeated instances of disorderly and violent behavior by the accused while under the influence of alcohol, which had caused fear, disturbance, and disruption of peace within the local community.
Upon consideration of the material on record, the Court held the accused guilty under Section 355 BNS and proceeded to determine an appropriate sentence.
While awarding sentence, the Court emphasized a reformative approach, observing that community service serves as an effective tool for rehabilitation and social reintegration. The Court noted that alcohol-related misconduct undermines public order and affects the sense of security within the community.
Accordingly, the accused has been directed to perform community service by cleaning the court premises at Pampore for a period of one month, from April 27, 2026, to May 26, 2026, between 10:30 AM and 4:30 PM, under the supervision of the Bar President. Compliance is to be verified through a formal certification to be submitted before the Court.
The Court further clarified that failure to complete the assigned community service would result in a default sentence of six days’ simple imprisonment.
The prosecuting officer effectively presented the case and assisted the Court by placing relevant facts and circumstances on record, thereby facilitating a just and balanced adjudication.
The order reflects a progressive judicial approach aimed at balancing accountability with reformation, reinforcing the importance of maintaining public discipline while encouraging corrective conduct.
