Communication is key–I ensure my clients are regularly updated on their cases despite the time zone differences. I also focus on building trust, as many NRI clients rely on me to handle sensitive matters such as property disputes, inheritance issues, or investments. My priority is to provide them with seamless legal support, making them feel connected and confident in the process, no matter where they are located.
The Indian legal landscape has been evolving rapidly in recent years. What are some of the biggest challenges and opportunities you see for lawyers in India today?
The increasing globalization of the Indian economy has presented numerous opportunities for lawyers. Cross-border transactions, international arbitration, and foreign direct investment have become increasingly important areas of practice. However, the legal profession also faces significant challenges, such as the need to adapt to technological advancements and the increasing complexity of regulations. To stay ahead, lawyers must continuously update their knowledge and skills, embrace technology, and develop strong international networks.
The Indian legal system has often been criticized for its delays and complexities. What steps can be taken to streamline legal processes and improve access to justice for ordinary citizens?
To streamline legal processes and improve access to justice for ordinary citizens in India, several measures can be implemented. These include judicial reforms to increase the number of judges and establish more courts, integrating technology for e-filing and virtual hearings, and simplifying legal procedures to make the system more user-friendly. Strengthening legal aid programs and raising public awareness about legal rights can empower citizens, while promoting alternative dispute resolution (ADR) mechanisms like mediation can help resolve disputes more quickly. Additionally, better case management systems can track and prioritise cases to enhance efficiency, ultimately working towards reducing delays and complexities in the legal system.
How would you characterize the corporate and domestic culture within the legal profession?
The corporate culture in law emphasizes efficiency, results, and strategic collaboration, often in fast-paced environments where meeting client expectations is crucial. In contrast, domestic legal culture is more traditional, focusing on personal relationships, ethics, and community service. While corporate law is competitive and results-driven, domestic law prioritises trust-building and ethical responsibilities, requiring a commitment to professional integrity in both areas.
Back home, we see a tremendous rise in divorce rates in Kashmir. What factors contribute to this trend, and how can the legal system be reformed to ensure a fair and amicable resolution of matrimonial disputes?
Several factors, including changing societal norms, increased financial independence of women, and rising expectations in marriages, contribute to the increasing divorce rates. To facilitate amicable settlements, we need to encourage mediation and counseling services. Additionally, reforms in maintenance laws and child custody provisions can help reduce conflict and ensure the well-being of families.
What are your thoughts on access to justice for ordinary people in Kashmir?
Access to justice remains a challenge due to financial constraints, limited legal awareness, and the disruption of legal processes during periods of unrest. However, with technology and community initiatives, we are making
progress in bridging these gaps.
What role do lawyers play in shaping society in Kashmir?
Lawyers are not just advocates in court; we are also educators and community leaders. In Kashmir, where people often feel disconnected from the justice system, we play a crucial role in building trust, spreading awareness about legal rights, and ensuring accountability.
As a seasoned lawyer, what advice would you give to young law students and aspiring lawyers in Kashmir?
My advice to young lawyers is to develop a strong foundation in legal principles, cultivate a passion for lifelong learning, and build strong relationships with colleagues and clients. It’s also crucial to develop excellent communication and problem-solving skills. Additionally, gaining practical experience through internships and clerkships can be invaluable. I am optimistic. With increased awareness, better connectivity, and the younger generation stepping up, the legal profession here is evolving. However, we must work collectively to ensure that justice remains accessible to all, irrespective of socio-economic status.
