It all started with a movie, Spotlight, which triggered me to write about child sexual abuse. “Spotlight” is a 2015 American biographical drama film directed by Tom McCarthy. The film follows a team of investigative journalists working for The Boston Globe as they uncover the widespread and systemic cover-up of child sexual abuse by Catholic priests in Boston, Massachusetts. The story is based on the true events that occurred in the early 2000s and was a major scandal in the Catholic Church.
Though I don’t have concrete data about it when it comes to child sexual abuse in Jammu and Kashmir, I believe that this issue is a pandemic all over the world and Jammu and Kashmir is no exception. Most of the victims are kids irrespective of their gender and the fact of the matter is it happens in all societies all over India including Jammu and Kashmir. This became the reason why Judiciary had to intervene in the matter.
The historical background of the POCSO Act dates back to the 1980s when India started recognizing child sexual abuse as a serious problem. It was not until the 1990s that the Indian judiciary started recognizing the gravity of the situation and started hearing cases of child sexual abuse. In 2005, the Supreme Court of India issued guidelines to address the issue of child sexual abuse, which included the establishment of a special court for the trial of child sexual abuse cases. The guidelines were incorporated into the POCSO Act, which was enacted in 2012.
The Protection of Children from Sexual Offences (POCSO) Act was passed by the Indian parliament in 2012 to protect children from sexual abuse and exploitation. The Act aims to provide a comprehensive legal framework for the protection of children from sexual abuse and exploitation.
But one of the loopholes in the implementation of the POCSO Act is the lack of awareness among the general public, including children, about the act’s provisions. This lack of awareness often leads to a failure to report cases of child sexual abuse. Additionally, societal pressure, religious beliefs, and peer pressure can make it difficult for victims to come forward and report the abuse. In some cases, victims of child sexual abuse may be subjected to pressure from their families not to report the abuse, particularly if the abuse involves incest or the involvement of close relatives. The closed society effect prevalent in rural areas of India can also be a significant impediment to reporting child sexual abuse cases.
One of the major challenges in highlighting the issue of child sexual abuse is the Muslim society syndrome, where there is a fear of being perceived as anti-Muslim when discussing issues such as child sexual abuse within the Muslim community. However, it is essential to recognize that child sexual abuse occurs across all communities and that the protection of children is a universal concern. And yes, the Kashmiri Muslim society should speak about child sexual abuse as it is a grave violation of child`s rights and can have long-lasting impacts on their physical, emotional and mental well-being. Keeping silent on this issue will only perpetuate the problem and prevent the victims from getting the help they need.
To address the challenges in the implementation of the POCSO Act, there is a need for increased awareness and sensitization among the general public, including children, about the provisions of the act. The establishment of support systems such as counseling and legal aid for victims of child sexual abuse can also be helpful. Police can play a critical role in reporting cases and implementing the POCSO Act and protecting children from sexual offences. They need to be vigilant, sensitive, and responsive to ensure that the law is effectively enforced and justice is served.
Additionally, the government can work with community leaders, NGOs and religious organizations to increase awareness about child sexual abuse and the importance of reporting such cases. It is crucial to create an environment where victims of child sexual abuse feel safe and empowered to come forward and report the abuse. By working together, we can ensure that children are protected from sexual abuse and exploitation.
In conclusion, child sexual abuse is a global issue that requires immediate attention and action. While the POCSO Act in India provides a comprehensive legal framework for the protection of children from sexual abuse and exploitation, there are still challenges in its implementation due to a lack of awareness and societal pressures. It is essential to increase awareness, sensitization, and support systems for victims of child sexual abuse, and to work collaboratively with community leaders, NGOs, and religious organizations to create a safe and empowering environment for victims to come forward and report the abuse. By addressing these challenges and working together, we can ensure the protection of children from sexual abuse and exploitation, and create a safer and healthier future for our children.
