HC quashes PSA of Kulgam man suffering from cancer

SRINAGAR: The J&K High Court has ordered release of a Kulgam man suffering from cancer who was booked under Public Safety Act soon after the abrogation of Article 370.
The court of Justice Ali Mohammad Magrey while giving reference to Supreme Court judgement in the case titled Khudiram Das versus West Bengal observed that the Court has explained in detail the duties cast upon on the
detaining authority and the rights of detenue under Article 22 of the constitution.
“Accordingly, the detention against Parvaiz Ahmad Pala resident of Matibugh Yaripora, Kulgam is quashed and the detaining authority is directed to release the detenue forthwith,” Justice Magrey ordered.
Parvaiz was picked in a midnight raid from his home at Kulgam’s Matibugh village on August 6 on the grounds of being an over ground worker. The dossier prepared by police mentions Parvaiz as over ground worker and
instigator. It points to an incident of 22 October 2017, in which he was accused of working at the “behest” of Hizbul Mujahideen commanders and targeted a PDP political worker Sheeraz Ahmad.
“You caused huge damage and harassed the family members of the said political worker. These allegations were proved against you during investigation.
“So to stop you from indulging in any prejudicial activity, it is necessary to detain you under Public safety act,” it read.
Parvaiz is suffering from papillary thyroid carcinoma and is currently lodged in Bareily Jail in Uttar Pradesh since August 8.
