Srinagar: A fresh Public Interest Litigation in the J&K High Court has sought constitutional safeguards for preserving inherited identity of Kashmiri Pandits, which it says are under threat due to abrogation of Article 370,
Art 35 A.
The PIL filed by advocate Rekha Wangnoo claims that the scrapping of Article 370 and 35A of Indian Constitution and subsequently passed orders “directly and indirectly result into a situation which will take away the
precious and prized indigenous identity of Kashmiri pandits in terms of rights on land, employment, immovable property and culture”.
Rekha identified herself as an indigenous inhabitant of Kashmir belonging to a microscopic ethnic minority of Kashmiri Pandits “who are in utter shambles from last 30 years due to internal and external disturbances”.
She pleaded that the non-existence of procedural safeguards and protections as created without keeping in view the delicate balance between the social security, citizen freedom and the personal liberty of indigenous
domiciles “is nothing but an attempt to dilute and demolish the 5000 year old ethnic Kashmiri civilization especially Kashmiri Pandits who have remained in exile for last 30 years and have been striving to return and
preserve their indigenous social, cultural and linguistic identity as Kashmiris”.
Hearing the petition, the Division Bench of Chief Justice Gita Mittal and Justice Rajesh Bindal directed Government of India and J&K to clarify if the issues raised in the petition are sub-judice in the Supreme Court.
