Dr Kaiser to helm GMC Srinagar Dr Samia removed on court orders

Srinagar: Under High Court orders, the J&K Government on Friday removed Dr Samia Rashid as Principal, Government Medical College (GMC) Srinagar, and appointed Dr Kaisar Ahmed Kaul as interim head till the time the post is filled up.
The court today directed Dr Samia Rashid to stop functioning as Principal GMC and the Registrar Judicial of the court was called upon to implement the direction. The Inspector General of Police was directed to assist the Registrar Judicial in case any difficulty was faced with respect to implementation of orders.
The court while coming down heavily on state authorities noted that they were not denying that Dr Samia Rashid was continuing on the post, which meant that they were well aware of her continuation on the post even with no legal or justifiable authority.
The court said that the respondents could not even plead ignorance of the court directions as all of them had been regularly represented by their counsels. “Therefore, the disobedience is right from 28 February, 2019,” the court noted. “The knowledge of the respondents is further corroborated by the fact that the judgement of the court of which the violation is alleged has been served upon respondents with promptitude after its pronouncement.”
The court remarked that the prestige, honour and dignity of the court was supreme. “It is not only the power but the duty of the court to uphold and maintain the dignity of the courts and majesty of law. For proper administration of justice and due compliance of the orders passed by court, it is required to take stringent action devisable under the law,” the court noted and recorded.
Senior Additional Advocate General (AAG) Javed Iqbal placed on record a copy of the communication addressed to him by the Deputy Secretary to the General Administration Department (GAD) revealing therein that the matter for regular appointment of the Principal, GMC, was under consideration of the Government and because of Darbar Move and the engagement of officers with Election related matters, the meeting of the Selection cum Establishment Committee could not be convened after 8h March, 2019. Further, the communication stated that the Government was in the process of complying with the court orders within two weeks positively.
The court had directed the Chief Secretary of the state and the Principal Secretary, Health and Medical Education department, to implement its orders passed on 28 February, 2019, within two weeks.
The court on February 28 this year had overturned the appointment of Dr Samia Rashid as Principal GMC and directed the State Government to make interim arrangement within four weeks. But the order was not followed, which compelled Dr Javed Choudhary to move a contempt petition.
