Explain appointment against post held up by court: HC directs Commissioner HME

Srinagar: The J&K High Court has directed Commissioner/Secretary to Government, Health and Medical Education Department, to appear before the court to explain the appointment of another candidate against a post held up by the court.
The government in February appointed Shahid Bashir Wani as assistant professor in Radio Therapy in Government Medical College, Anantnag.
However, petitioner Dr Nahida Yousuf challenged the order citing the appointment was the subject matter of adjudication in a petition, where the court had directed the post shall not be filed up.
Justice Sanjeev Kumar, while hearing the petitioner counsel Shafkat Nazir, stayed the appointment till further orders and listed the matter for April 16.
Dr Nahida Yousuf had earlier been appointed on the post in October 2018.
After her appointment, Principal GMC Srinagar passed an order cancelling the experience certificate earlier issued to her, on grounds that the maternity leave taken by her had not been reflected in the certificate.
After that the Public Service Commission issued an order withdrawing the recommendation for appointment of Dr Nahida on the basis of cancellation of experience certificate.
Dr Nahida challenged the order in the court which directed the respondents not to fill up the post of Assistant Professor in the discipline of Radiotherapy in Government Medical College, Anantnag, notified vide Advertisement Notice No. 01-PSC (DR-P) of 2018 dated 17.01.2018.
Despite the order, the Commissioner/Secretary to Government, Health and Medical Education issued the order appointing Shahid Bashir Wani against the post.
