Srinagar: The J&K High Court on Wednesday issued notice to state authorities asking for their reply to a petition seeking judicial inquiry into the incident at Lal Ded (LD) Hospital wherein a pregnant woman from Kupwara was turned away from the hospital, after which she delivered her child on a roadside.
Justice Sanjeev Kumar issued the notice to various officials of the state government calling for their reply within four weeks.
A writ petition was filed by Advocate Shah Faesal seeking a time-bound judicial inquiry to be headed by a sitting District Judge into the incident which happened on 17th January 2019 at LD hospital Srinagar.
The petitioner also sought a writ in the nature of mandamus commanding the respondents to provide specialist doctors including gynecologists, medical and surgical facilities in all district hospitals, sub-district hospitals and primary health centers of Jammu and Kashmir.
Petitioner also sought writ in the nature of mandamus commanding the respondents to upgrade/augment the infrastructure of sub district hospital Kupwara to District Hospital Kupwara.
Directions were also sought commanding the Senior Superintendent of Police to register an FIR against the doctor/s in terms of relevant provisions of Ranbir Penal Code and act against them. Furthermore, directions were sought in the nature of writ of mandamus commanding the respondents to pay an amount of Rs 50 lakh rupees to the Kupwara woman as compensation for criminal and medical negligence.
