Srinagar: The J&K High Court on Tuesday directed state government authorities to move an application before the court seeking expeditious disposal of all land acquisition cases related to project of road widening from Boulevard to Hazratbal.
The direction was passed so as to ensure that process of acquisition is expeditiously completed and the project of road widening is not delayed any further.
By order dated 31 August, 2018, the High Court had directed Deputy Commissioner (Land Acquisition Authority) to give specific details about action taken for acquisition of land, release of compensation, taking over of possession of land, as well as status of availability of funds for compensation.
Today, when the PIL related to road widening from Boulevard to Hazratbal came up for hearing, a division bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar recorded in the order that a status report dated 19 November, 2018, has been filed before the court, on perusal of which the court found that reference had been made to several land acquisition cases pending before courts. The majority of these cases related to compensation.
The court also recorded that in a few cases there appeared to be dispute among the land owners, family disputes, and partnership disputes. In other cases, orders of status-quo had been given by courts.
After noting the difficulty faced by the Land Acquisition Authority, the High Court directed state counsel BA Dar to move an application before the HC seeking disposal of all these cases.
The court also directed that a status report regarding filing of applications and the fate thereof be placed before the bench on 18 March, 2019.
The road widening project from Boulevard to Hazratbal commenced from 2002 but its still pending due to issues of land acquisition.
