Srinagar: A trial court in Srinagar has granted interim bail to a Jammu-based youth accused in the kidnapping of a minor girl hailing from Uttar Pradesh on the grounds that the minor girl has not deposed anything incriminating against the accused so far.
Chief Judicial Magistrate (CJM) Srinagar granted the interim bail to the youth till 6 October under the condition that the accused must not leave Kashmir and should cooperate with the investigating officer for proper investigation.
The accused, Shiva son of Puran Singh, a resident of Jammu, was arrested by the police under FIR 113/2018 for the commission of offence u/s 363 (Kidnapping) RPC.
Counsels for the accused, Adil Rashid Bhat, Qazi Athar and Wasim Raja Bhat, submitted before court that the accused is innocent and has not committed any offence.
The defence counsels invoked the statement of the girl recorded under 164- A before the judicial magistrate in which, as per the counsels, “she has not deposed anything which puts blame on the accused”.
On the other hand, Prosecuting Officer filed objections and opposed bail on the grounds that the accused has committed a heinous and non-bailable offence and is involved in kidnapping of a minor girl and deserves no concession.
The Court after considering the submission and arguments and after going through the case diary file of the case granted the interim bail to the accused subject to the conditions that the accused shall not leave the Valley and shall mark his presence every day before the Investigating Officer of the case, till further orders.
