SRINAGAR: Taking note of the case of Haji Abdul Gani Bhat, a 65-year-old Sopore resident presently detained at Srinagar Central Jail, who was allegedly forced to remain naked in the jail premises, the J&K High Court on Wednesday directed the District Legal Service Authority to file a report on the issue and produce it before the bench within two weeks.
Amicus Curiae G R Tantray complained before court that a 65-year-old detainee had been forcibly rendered naked in the jail premises. Calling it the worst form of human rights violation, Tantray asked why this sort of treatment is meted out to jail inmates.
Hearing the PIL on providing facilities to inmates/prisoners, the division bench of Chief Justice Gita Mittal and Justice Alok Aradhe remarked that the jail manual has to be followed and said that what is law on the ground cannot be overlooked.
The court said and directed that a report regarding the compliant should be filed before court.
Meanwhile, the court asked the legal service authorities across the state to inspect jails and present reports before court.
It also directed state counsel M A Beigh to approach the member secretary, Legal Service Authority, New Delhi, to view and examine the fresh jail manual prepared for jails so that it can be of benefit here in J&K also.
The direction was passed in view of the observations on whether jail manuals are updated in J&K state or not with respect to providing inmates with basic facilities.
