J&K HCBA condemns arrest of Hussain Rashid

SRINAGAR: J&K High Court Bar Association, Srinagar, strongly condemns the arrest and detention of Advocate Hussain Rashid of Shiva Pazalpora, Sopore, who was picked up from his home during the intervening night of 1/2nd September, 2018, by SOG Sopore and since then is in their illegal captivity.
The Bar Association while terming the arrest and detention of Advocate Hussain Rashid a flagrant violation of law and also against the decisions of Indian Supreme Court, which requires the police personnel carrying out the arrest and handling the interrogation of the arrestee to inform him the grounds of his arrest and shall allow one of his friends, relatives or other person known to him or having interest in his welfare of being informed, as soon as practicable that he has been arrested and is being detained at a particular place and that the arrestee should also be got examined at the time of arrest and major or minor injuries present on his body, if any, must be recorded and he should be subjected to a medical examination after every 48 hours, during his detention in custody by a doctor on the panel of approved doctors appointed by Director Health Services of the concerned State and also permit his lawyer to meet him during interrogation. Since the police SOG personnel of Camp Sopore, have violated the aforesaid directions of the Supreme Court with impunity therefore, the Bar Association demands that the detention of Advocate Hussain Rashid should be brought to an end forthwith and he be released unconditionally from the unlawful detention, failing which the Bar Association shall have no option but to bring the matter before to the notice of the Hon’ble High Court by moving an appropriate petition in this regard before it.
Advocate Hussain Rashid, who is practising at the High Court, Srinagar from 2014 and has also remained associated with Advocate Mohammad Amin Wadda, for quite some time, lost his brother Dr. Asif Rashid in March, 2018. He got married on 26th of August, 2018, but within seven days of his marriage, he was arrested by SOG Sopore without any rhyme or reason and without disclosing him the grounds of arrest and is presently in their illegal custody. His father Abdul Rashid Mir, who is a retired Govt. Teacher, had approached the police personnel of SOG Camp Sopore, many a times, for allowing him to meet his son but his requests have been turned down unceremoniously and without assigning any reason.
