Srinagar: A court here granted anticipatory bail to a ZEO and accountant of Education department, accused of drawing a teacher’s leave salary into their own account.
The Court of Special Judge Anti-Corruption Srinagar Friday granted interim bail to Zonal Education Officer Batamaloo Iftikhar Ahmed Fazili, and accounts assistant Farooq Ahmed Sheikh till July 30 in anticipation of their arrest, in a case under FIR 27/2018 under section 409 RPC and section 5 (2) Anti-corruption Act.
Ishtiyaq Ahmad Khan, the counsel for the accused had submitted application for bail in anticipation under section 497-A.
The two officials are accused of withdrawing the salary of a teacher, Masooda Banoo, during a leave period of 42 days, when she had proceeded on Hajj pilgrimage in 2014.
The teacher had been posted at Government Middle School Shivpora Srinagar and had gone on leave for 42 days in 2014.
On her return she was informed that 42 days “leave without pay” was granted in her favour as such salary for the month of Nov-2014 was not drawn.
However, according to her complaint, she later came to know that actually 42 days “Commutation leave” was sanctioned in her favour and that salary for that period (Rs 29,517) had been drawn which was embezzled by the concerned accountant of ZEO office.
The Crime Branch Kashmir, on a complaint by the teacher, found on investigation that 42 days “commutation leave” was sanctioned in her favour but she was informed that leave “without pay” has been sanctioned in her favour.
