SRINAGAR: A local court on Tuesday rejected bail to three persons accused of abetment to kidnapping and rape of a minor girl in Nowgam area of Srinagar.
Last year police had arrested four people on charges of kidnapping and raping of a minor girl in Nowgam area of Srinagar. Of the four, three accused Umar Ali Dar, Umar Hamid Laway and Talib Parvaiz in case under FIR No. 136/2017 of Police Station Nowgam under Section 363,376,109 RPC had moved for bail. While a fourth man is accused of the rape, the three are accused of aiding and abetment in the kidnapping and rape of the minor girl, who had lost her way.
Rejecting the bail application the court observed that the offence of rape and outraging the modesty of women were on rise in the society, and the accused, in this case, cannot take the excuse that they did not commit the rape themselves. “Rape is such a heinous, shameful and immoral act where the abettor cannot get absolved in degree of culpability by showing this sham argument that he himself did not commit rape and the other did it. To facilitate this nefarious crime to be committed and even to abet the same is equal in degree in culpability as that of the rapist himself. In the instant situation, if all three applicants had living conscious in them with a good degree of morality and probity, could have saved the chastity and modesty of a minor girl, who lost her way and should have taken her at home, reflecting morality and human values, but instead took her to the unknown destination, and got her raped,” the court said.
