SRINAGAR: A local court on Tuesday directed prison authorities and prosecution to produce the accused along with witnesses in the DSP Ayub Pandith lynching case before the court for examination on the next hearing – June 22.
As the prosecution failed to produce the accused, the defence counsel pleaded that the statement of prosecution witnesses can be recorded in absence of the accused.
He said that that the authorities have failed to produce the accused before the court on eighth consecutive hearing “with the aim and object to protract the trail of the case without any reason and justification, thereby preventing the court to record the statement of the prosecution witnesses”.
He added that the failure of producing under trail amounts to contempt in perpetuity as the court has been directing the state authorities to produce the accused before the court for long.
“Under such circumstances only course available before the court is to grant bail to the accused persons so that they will cause the presence on each and every date of hearing for the conclusion of the trail of the case,” he said.
The next hearing of case has been listed on 22 June.
