Srinagar: A local court on Wednesday granted absolute bail to JKLF zonal president Noor Muhammad Kalwal who was booked by Police Station Maisuam under FIR no 25/2017 under sections 307, 148,147, 149, 353 RPC and under section 13 A unlawful activities act.
After hearing the arguments from Kalwal’s counsel, the court made the interim bail order absolute as the counsel told the court that the FIR 25/2017 was an old one while the accused had been arrested in 2018.
Kalwal had earlier been released on an interim bail by the court which was made absolute today, as the counsel for the accused pleaded that FIR was going to culminate into presentation of chargesheet.
“Therefore the accused is not required for interrogation purposes by the police station Maisuma as the investigation in this case is complete excepting the arrest of a few more accused persons is awaited. This is the lacuna and infirmity in police investigation, cannot be as such imposed upon the shoulders of the accused,” defense counsel said.
Kalwal had initially moved application under section 497 A CrPC before the 2nd Additional District and Session Judge Srinagar who after hearing the bail in anticipation rejected the same on the ground that under 13 ULA act, no bail can be granted.
Thereafter, Kalwal filed regular bail application before the CJM Srinagar who transferred it to Forest Magistrate Srinagar.
“The facts of the case revealed that the accused Noor Muhammad Kalwal had been booked under the said FIR on the basis of false and frivolous grounds as he had booked by the police in the year 2017 under various sections,” Kalwal’s counsel Aijaz Ahmad Dar told Kashmir Reader.
