Ganderbal court rejects bail of rape accused

GANDERBAL: A trial court in Ganderbal Monday rejected the bail of a man accused of kidnapping and raping a minor girl.
Principal District and Sessions Judge Ganderbal, Raja Shujaat Ali Khan, rejected the bail of Ajaz Ahmad Mallah of Watlar Ganderbal.
Mallah is accused of kidnapping and raping a 15-year-old girl. According to the prosecution the father of the girl had filed a missing complaint in September 2017. During investigation it surfaced that she had been kidnapped by the accused, from whose custody, he was later recovered at Lal Chowk Srinagar, along with the accused. A medical examination confirmed sexual assault, while a ossification test determination her age at more than 18 and less than 21,
However, not satisfied with the ossification test the investigation officer obtained a date of birth certificate from the school last attended by her, which showed the age as 15.
Malla’s bail application was resisted by the state prosecutor stating that offences committed by accused were heinous and non-bailaible one as the victim was a minor who has been kidnapped from lawful guardianship. The court concluded that that the accused was not entitled to any relief at this stage and referred various judgements on this count.
The court also directed the SSP Ganderbal to seek explanation from the investigating officer on why the abettors have been left out from the case.
