Srinagar: The J&K High Court Saturday directed the state government and Central Jail authorities to provide proper medical assistance to Ashiq Hussain Faktoo alias Dr Qasim.
Disposing of a petition, the division bench comprising of Justice MK Hanjura and Justice Ramalingam Sudhakar directed authorities to shift Faktoo to JLNM Hospital, Rainawari for orthopedic consultations and to SMHS Hospital for ophthalmology and neuro check ups.
The court also directed principal Government Medical College, Srinagar to constitute a team within one day from the receipt of the order.
“Superintendent shall facilitate the arrangements and shall treat the appellant as per the advice of doctors,” the court said.
Senior advocate Mian Qayoom had moved the application before court seeking proper medical assistance to Faktoo.
Faktoo who is suffering from many ailments has completed 25 years behind bars and is still waiting relief under Jammu and Kashmir Jail Manual 2000 for remittance of his natural life sentence, he said.
The application said that that state has failed to comply with earlier directions given by the court on in December 2013 for providing medical assistance to Faktoo.
The court had then directed the principal/dean of GMC, Srinagar to constitute a team of doctors comprising of one orthopedic surgeon from Bone and Joint Hospital Srinagar, one doctor with specialization in gastroenterology and an eye specialist to examine Faktoo in Central Jail.
“The directions were not observed by respondents in the letter and spirit, as a result the appellant continues to suffer of the ailment. Presently he is suffering from severe backache and regular loss of vision due to Glaucoma and is feeling numbness in left arm and left leg,” the application said, noting that if he is not shifted to the hospital “he won’t be able to move or see.”
