SRINAGAR: A consumer court in Srinagar on Monday penalised a LPG gas distributor for not providing regular gas service to a consumers and issued a non-bailable warrant against its proprietor for violating earlier court orders.
The consumer forum also passed direction to SSP Srinagar to ensure the arrest of the proprietor of the agency, Jay Kay Gas Company HP Gas Distributor Baghi Ali Mardan Khan in Nowshera and asked police to produce him in the forum.
The forum observed that the distributor paid no heed to the earlier direction which constrained the complainant-consumer to file an execution petition of the said order. Thus court is convinced to issue non-bailable warrant against the proprietor of the company and same shall be done on next hearing, said the order.
A consumer had earlier filed a complaint against Jay Kay Gas Company situated at Nowshera Srinagar for not providing him gas cylinders as per government norms. The consumer had provided his consumer pass book as evidence by which the consumer court slapped the charges on the distributor.
The District Consumer Protection Forum asked the agency to pay an amount of Rs 5000 to the consumer, including Rs 2000 as litigation charges.
“Accordingly, the complaint is disposed of with the direction to pay an amount of Rs 5000/ to the complainant as compensation for causing pain, agony and harassment by the company. The company shall also pay Rs 2000/ as litigation charges to the complainant”, consumer court directed.
However, the court also directed that the entire awarded amount shall be paid by the distributor to the complainant with a period of one month, failing which same shall bear simple interest at 6 percent per year.
