Srinagar: J&K High Court Bar Association Srinagar has expressed deep concern over the “use of judicial system by the RSS-BJP combine to get Article 35-A of the Constitution of India, as applicable to J&K, struck down” and the filing of an appeal against the judgment of the Delhi High Court which had dismissed the petition challenging Article 370 of the Constitution of India and the constitutional application order of 1954.
“The Bar Association maintains that fiddling with Article 35-A of the Constitution of India, will be disastrous and will have serious ramifications in the state,” a statement issued by the Bar Association here said on Wednesday.
Bar called for united defence against any such move. “As such, all the right-thinking people should unite and chalk out a common strategy to defeat the sinister designs of all communal and fascist forces,” it said.
“On its part the Bar Association has already drafted a petition for becoming a party to the petition filed before the Supreme Court, for striking down Article 35-A of the Constitution of India and if needed, the same will be filed in the court, before the next date of hearing.”
The Bar Association has also decided to support the strike call given by the pro-freedom leadership on 12th of August, 2017 in opposition to the filing of the petition for striking down of Article 35-A of the Constitution of India and has decided to request its members not to cause their appearance before the courts on the said date.
