SRINAGAR: A trial court in Srinagar sentenced Nazir Ahmed Sheikh, a resident of Rainawari to 10-years imprisonment for raping her minor daughter.
The court also imposed a fine to Rs 10,000 on the convict, and recommended state government to pay Rs 3.00 lacs to the victim as compensation.
The 2nd additional sessions judge Sham Lal Lalhal observed that the convict being a father and natural guardian of the victim was under moral and legal obligation to look after and protect the victim but instead of this he has committed the shameful act with his daughter.
Due to this act not only the victim has suffered mental agony, stigma and traumatic experience but it has shaken the conscience of the society at large, the court said.
Stating that crime was highly reprehensible, the court observed that even though the guilty was aged and has remained in lock up for seven to eight years he doesn’t deserve any sympathetic view.
“It is also in the interest of the society at large to impose appropriate sentence upon him,” the court said.
Sentencing Sheikh to ten years imprisonment with a fine of Rs 10,000 under section 376 RPC, the court observed that the period of imprisonment undergone by the convict in judicial lock up shall be set off against the period of imprisonment sentence. In case of default in payment of fine, the convict shall undergo further six months imprisonment.
Stating that the victim has suffered great pain and mental trauma while her career and life has been spoiled, the court observed that it was necessary to compensate and rehabilitate her according to the J&K victim compensation scheme 2013 vide SRO 229 dated 23.4.2013.
“Therefore it is recommended that the state government through Principal secretary government home department/member secretary J&K state legal services authority shall pay Rs.3.00 lacs to the victim within two months from the date of passing of this order.”
