SRINAGAR: A court in Srinagar has convicted four persons from Lajoora Pulwama for the killing of their neighbour Mushtaq Kuchay in 2010.
District Principal and Sessions Judge Rashid Ali Dar held Rayees Ahmed Mir and Nazir Ahmed Mir guilty under section 302/34 RPC for killing of Kuchay, a PHE employee at Rakhi village in Lajoora Pulwama.
Two other accused Parvaiz Ahmed Mir and Ghulam Qadir Mir were held guilty under the offences under section 148,149,447 RPC, for usage of deadly weapon and criminal trespass. Rayees and Nazir held guilty for murder may get life imprisonment.
Another accused Kaisar Sultan Bhat is absconding and court has already issued warrant against him under section 512 CrPC and has directed SP Pulwama to arrest the accused and produce him before the court.
On 21 August 2010, a minor scuffle broke out between two neighbours about a compound wall at Village Rakhi, Lajoora Pulwama where Rayees, Parvaiz, Ghulam Qadir, Zahid Ahmed Mir and Kaisar were quarrelling with their neighbour Mushtaq Kuchay when Rayees instigated by Nazir to uproot the wall and instigated him to injure the victim.
According to case details the victim was hit by Rayees on his head while Nazir caught hold of him by neck. This led to his death at SKIMS hospital few days later.
Although five accused were arrested on spot but Kaisar absconded the arrest till date.
Accused Zahid is on bail as he is a juvenile and Ghulam Qadir for being elderly.
The quantum of sentence will be announced on 13 March. Parvaiz has been directed by court to be present on 13th march as he has already served detention period of 6 years, 6 months and 12 days and may be set free under section 307-A of CrPC.
