Minor, 78-year old among those ordered for release
SRINAGAR: The J&K High Court has quashed detention order under Public Safety Act against seven persons including a 78-year-old man and a minor from Sopore town of Baramulla district.
Five of the detention orders were quashed by a bench of Justice Tashi Rabstan after hearing separate petitions filed by the detainees through their counsel.
Disposing of a petition, the court directed authorities to release Mohammad Yousuf Sheikh (78) son of Late Mohammad Maqbool Sheikh of Iqbal Nagar, Sopore.
The court passed the order after his counsel argued that the district magistrate has made use of grounds that had been relied in earlier detention order (68/DMB/PSA/2016) passed against Sheikh on 10 August last year, which was quashed by the Court on November 23 last year.
“Respondents, in view of quashment of detention order, are stripped of any authority to continue to detain the (Sheikh) under order No.194/ DMB/PSA/16 dated 14th December 2016,” the court said.
Similarly, court also ordered release of Mohammad Lateef Dar, 54, son of Late Abdul Gani Dar of Zawoora (Dar Mohalla) Shopian after quashing detention order (67/DMS/PSA/16) passed by the District Magistrate, Shopian on 29 September last year. “Respondents are directed to set the (Dar) at liberty,” the court said.
It also ordered release of Zahid Ahmad Nengroo son of Mohammad Yousuf Nengroo of Tuli Nowpora Kulgam after quashing his detention (39/DMK/PSA/16) passed by the district magistrate Kulgam on October 29 last year.
The court also allowed plea Hilal Ahmad Itoo son of Abdul Ahad Itoo of Rahmoo Rajpora of District Pulwama against detention order (No.88/DMP/PSA/16) passed by the district magistrate Pulwama on September 17.
“The respondents, in view of quashment of detention order, are stripped of any authority to continue to detain the detainee under (detention order),” the court said.
The court also quashed detention order (99/DMP/PSA/16) passed by district magistrate Pulwama on September 23 last year against Manzoor Ahmad Lone son of Ghulam Nabi Lone of Lelhar, Kakpora Pulwama and directed the authorities to release him from the preventive detention.
Meanwhile, a single bench of Justice S. Sudhakar quashed detention orders under PSA against Nazir Ahmad Mantoo of Harmain Shopian and Muzaffar Ahmad Sheikh son of Abdul Majeed Sheikh of Sangrama Sopore who as per school leaving certificate is a minor.
The petitioners were represented by advocates Shafaqat Nazir, Nasir Qadiri Wajid Haseeb, G. N. Shaheen, Junaid Rashid and Tariq Ahmad Lon.
