SRINAGAR: The Jammu and Kashmir High court on Monday asked Director School Education Kashmir to submit his explanation within two weeks over “wrong information” to higher authorities regarding a plea by a contingent paid worker.
Hearing a petition, a single bench of Justice Ali Mohammad Magrey also ordered Zonal Education Officer (ZEO) Kakapora to remain present before the court on next date of hearing on February 14.
The directions by the court followed submissions by counsel for the petitioner; Advocate Rafiq Ahmad Bhat that DSEK in his communication to higher authorities has made no mention about the court’s order passed on December 22 last year. Pending final decision, the court had directed officials of DSEK to consider the case of the petitioner for his permanent absorption against the post of PW available in Urichersoo Zone of Kakapora and had also directed them to release legitimately earned wages in favour of petitioner.
“The reading of the communication makes it clear that the DSEK is not conscious of the order passed by this court on 22 December 15, therefore, he has based the communication on wrong/incorrect facts contrary to the orders passed by this court. Wrong information submitted to the higher authorities contrary to the court orders amounts to forgery,” the court said, adding, “before proceeding against the DSEK, he is granted opportunity to submit his explanation on affidavit within two weeks.”
It also directed ZEO Kakapora to appear in person on next date and explain as to why he has not released legitimately earned wages in favour of the petition despite the court directions.
