SRINAGAR: A court here on Friday sentenced a government employee to one-year rigorous imprisonment and imposed a fine of Rs 10,000 on him for forging his date of birth in service records.
The employee, Javaid Ahmad Qadri of Sangeen Darwaza Hawal, at present Baghat Barzulla, was due to retire next year. According to a probe by vigilance organization, he had tempered the date of birth from 9 April 1957 to 9 April 1960.
“The figure ‘1960’ was found tempered and the word ‘sixty’ was also found suspicious. The date of birth certificate issued by the board of Scholl education Srinagar was also seized which shows that the actual date of birth of (Javaid Ahmad Qadri) as 9 April 1957,” the vigilance concluded.
Working as establishment clerk in R&B 2nd division, Javaid remained posted upto 1996 and as per practice, the service book of the officials used to remain in the custody of such clerks. The court of Additional Session Judge Srinagar, S R Gandhi, observed that the Javaid had the access to his service book.
“Except the accused (Javaid), no other person could have been benefited by the forgery in the service book inasmuch as (his) service could have been extended by three years.”
FSL opinion corroborates that it was Javaid who had committed the offence, the court said, rejecting his contention as “highly improbable” that the mischief was not done by him.
Accordingly, the court had convicted Javaid of offences under RPC Sections of 467 (forgery) and 468 (forgery for purpose of cheating).
“The convict has not derived any benefit by committing the forgery and in view of the aggravating and mitigating factors, I am of the considered opinion that it is not a fit case to impose maximum punishment,” the court said and sentenced him to undergo one year and the fine of Rs 10000 under RPC section 467. He was sentenced to similar punishment under section 468 PRC. However, the court said that both the sentences shall run concurrently. In case of the default of payment of fine, the court ordered that he shall undergo three months of imprisonment. Besides wife Javaid has three children.
