Vigilance files case against SSP Crime Branch

Srinagar: The Vigilance Organisation (VO) has filed a case against a top police official for committing fraud by “abusing” his official position in grabbing a piece of land in the winter capital of the state.
A VO official statement said the anti-graft body conducted investigations into the allegations against SSP Mubashir Latifi, currently posted as SSP Crime Branch Jammu, for embezzling eight kanals of land from Gujjars on the assurance that their kin would be employed as constables or SPO’s in the police department.
“The acts of omissions and commissions on part of the public servants beneficiary and others constitute offences under section 5(1) (d) r/w Section 5(2) J&K PC Act Svt. 2006 and 120-B RPC. Accordingly a case is registered at police station VO Jammu and further investigation is going on,” the statement said.
It said that the records of the district authorities in Jammu showed that the said khasra no 119 min comprising four kanals was state land with kasht entry of Nawab Din son of Makhan in 1972 till 1999. However, in 2005, state land measuring a kanal and 18 marlas in the same khasra was recorded in the name of Abdul Latief Balwan, father of Mubashir. In the following year, entry of kasht of Nawab Din for two kanals and two marlas was shown as a kanal 18 marlas under Balwan’s name.
“As for the purpose of vesting of ownership rights under Roshni Act, the beneficiary must have physical and recorded possession of land on Rabi 2004. But the following year, ‘intikal’ of one kanal from khasra No119 min has been committed in the name of Mohd Mubashir Latifi son of Abdul Latief Balwan of Doda under Roshni Act in 2008. The land under khasra No 120 being state land “Shar-e-Aam” with entry of “Gair Mumkin Rasta” till the year 2015 out of 9 ½ marlas has intikal entry under Roshni Act in favour of beneficiary Mubashir. The entry in Girdawari register of khasra No120 is not only as Shar-e-Aam but record shows no possession of any party on the said land,” it said.
The vesting of ownership rights under Roshni Act for residential purpose has been recorded in favour of Mubashir in violation of rules by “abusing official position in connivance with district approval committee Jammu”, the statement added.
