Seniority list of officers of J&K Administrative Service notified

Srinagar: Jammu and Kashmir government on Friday notified the final seniority list of the officers of the Jammu and Kashmir Administrative Service, appointed between January 01, 2009 to December 31, 20011.
The government also said the tentative list of seniority list of 151 officers appointed to the Jammu and Kashmir Service between January 01, 2009 and December 12, 2012 needs further consideration and the list will be notified separately.
“It has been, accordingly, found expedient in the interest of the administration to notify the final seniority of the members of the service appointed between 1.1.2009 and 31.12.2011 as it stood on 31.12.2011,” the government order said.
Therefore, the final seniority list of the officers appointed to the Time Scale of the Jammu and Kashmir Administrative Service between January 01, 2009 and December 12, 2011, as it stood on 31.12.2011, forming ‘Annexure’ to this order, is notified for information of all concerned officers.
“The seniority list shall, however, be without prejudice to outcome of the writ petitions, if any, pending before the Competent Court(s) of law. The seniority of the members of the service appointed/promoted during 2012 shall be notified separately,” said the order.
The order also said that the date of birth recorded in the seniority list shall not be taken as authentic, but is subject to verification from service book or matriculation certificate of the concerned officers.
According to the order, the tentative seniority list of 151 officers (excluding the retired officers), appointed to the Jammu and Kashmir Administrative Service between January 01, 2009 and December 31, 2012, as it stood on December 31, 2012, was notified vide Government order No: 223-GAD of 2014 dated 24.02.2014.
However, the order said that, it was stipulated that any officer, aggrieved with the position so assigned to him/her the list, may represent to the Government within a period of 21 days from the date of issue of the order, failing which it shall be presumed that the concerned officer(s) has/have no objection and the final seniority list shall be notified accordingly.
After receiving representation from 58 officials, the order said, certain substantial issues related to the list were raised.
“The issues have been examined in consultation with the Department of Law, Justice and Parliamentary Affairs and on such examination of the matter, it has been observed that the inter-se-seniority of the officers, appointed to the service during 2012, needs further consideration, and, as a consequence, their seniority shall have to be notified separately,” said the order.
The government has not taken any decision regarding the final seniority list of the members of the Jammu and Kashmir Administrative Service (KAS), appointed to the service between January 01, 2004 and December 31, 2008, notified vide Government Order No. 743-GAD of 2011 dated June 24, 2011.
“The case is subject to the final outcome of the writ petition(s) pending consideration before the competent court (s),” said the order.
Meanwhile, in a separate order, the government has directed to delete rule 8 of Jammu and Kashmir Civil Service Services (Revised Pay) Rules, 2009 and the table at the end of the first schedule with an effect from May 21, 2014.
