Srinagar: The J&K High Court has stayed a government order regarding posting of four officers as incharge Joint Directors in Agriculture Production.
“Subject to the objections and till next date of hearing, impugned order June 20, 2014 to the extend it pertains to respondents 2 to 5 shall remain stayed,” Justice D S Thakur said while hearing a petition by Ghulam Mohi-ud-Din Rather, who claims to have a right to be considered for promotion to the next higher post of Junior Director in the Department of agriculture Production.
The court also left it open to the government to consider the case of the petitioner for incharge arrangement along with all eligible.
“That government is entitled to make an interim arrangement to overcome the exigencies of work but while making such interim arrangements case of all eligible candidates should be considered to bring it in conformity with principles of fairness as applied in Article 14 of the constitution,” the court said.
The private respondents include Mohammad Mubarak Reshi, Ghulam Hassan Guroo, Aejaz Andrabi and A R Samoon.
