Srinagar: Jammu and Kashmir High Court has asked government to consider grant of extension of maternity leave to a contractual doctor in the same manner granted to permanent employees.
A bench of Justice Virender Singh passed the directions on a petition filed by one Dr. Bilquees Khurshid, challenging Rule 10(iii) of SRO 255 of 2003 whereby contractual employee is entitled to sixty days maternity leave without honorarium.
The court also stayed communications (No. DHB/NRHM/160-164 and CMOB/NHM/14/167-169) whereby Dr Bilquees, who was appointed as doctor under National Rural Health Mission in District Budgam on contractual basis, was not granted extension of maternity leave beyond sixty days and asked to join duty. The court also issued notice to government returnable within two weeks.
The bench has also recorded its December last order, asking state government to treat the contractual employees at par with the permanent employees in respect of maternity leave benefits.
