Molestation case: CDR, other details corroborate victim’s charges against ex-minister

Srinagar: The chargesheet filed by police has established claims by a lady doctor that she was forced to visit Civil Secretariat here on January 28, prompting her to file compliant of sexual assault against former Minister of State for Health and senior Congress leader Shabir Ahmad Khan.
“The call details record (CDR) regarding conversation of the (lady doctor) with Principal Assistant and Private Secretary to the (former MoS) on January 27 and 28 were received from BSNL and it was found that she had received calls from them,” the police has said in the chargesheet filed by it against Khan before Chief Judicial Magistrate here.
The minister had allegedly forced the doctor to meet him at Winter Civil Secretariat here on the pretext of seeking details about funds sought by her from Indian Health Minister Ghulam Nabi Azad for a health centre where she worked.
In the chargesheet, the police have recorded evidence regarding what according to the doctor transpired since January 27, when she was called by the minister’s staff and what happened inside the cabin at Civil Secretariat were she was made to sit for 10-15 minutes by the minister.
Khan, who is Congress’s star complainer for Parliamentary elections, has been charged under RPC sections of 354 (assault or criminal force to woman with intent to outrage her modesty) and 509 (word, gesture or act intended to insult the modesty of a woman).
In her compliant, the doctor has said that she is working as BMO and on January 27, she received a call from a man who identified himself as Mazhar Khan, ‘working as Special Assistant to the minister’.
“The caller after introducing himself, directed (me) to attend Winter Secretariat Srinagar along with the report about the announcements made by Azad on his visit to heath centre as the same is needed by Health Minister.”
The doctor had said that as she was not required, as per the office held by her to keep the record, she requested the caller to confirm the details from Director Health Services Kashmir, the competent authority. “Despite the request made, the Special Assistant insisted upon (me) to go to Winter Secretariat Srinagar personally and convey the same to minister.”
The doctor said as she was on a tour in the periphery of the block where she worked as BMO, on reaching back to office at about 5:36 pm, she called the Special Assistant back and informed him that she cannot go to Winter Secretariat at late hours and repeated that she does not have relevant information with her.
“The Special Assistant gave the mobile number of Private Secretary (Shahid) to the MoS and directed (me) to discuss the issue with him,” the FIR said.
At about 5:39 pm on January 27, she called the Private Secretary and conveyed same details to him. “The Private Secretary in turn again informed (me) to go to Health Minister and convey to him whatever minimal information she had.”
The doctor said that she showed reluctance to visit Health Minister’s office at late in the evening.
“The Private Secretary asked (me) to wait for his call after he will discuss the matter with the minister. That about 5:49 pm, (I) received a call from the Private secretary who told (me) to visit Winter Secretariat on January 28 after 2 pm along with whatever information.”
Besides calls details, the police has also verified from Security Wing of the Secretariat about entry of the doctor at Secretariat.
The police have also enquired details from peon of room number 6 (where the doctor was called to visit minister) as well as from security personnel of minister besides his Special Assistant and Private Secretary.
Khan, a sitting MLA from Rajouri constituency in the 87-member state Legislative Assembly, had resigned as MoS Health on February 7, a day after police registered the case (FIR no. 09/2014) under RPC sections of 354 and 509 based on a complaint by the doctor.
Khan, according to the FIR registered at Shaheed Gunj police station, said that he “acted like a sexual predator” and tried to molest her in his office at the Winter Secretariat on January 28.
