JAMMU: The Defence Department including the Army has encroached more than 2,500 kanals of Wakaf land in Jammu and Kashmir while 1,000 kanals have been grabbed by different government departments.
Replying to a query of People’s Democratic Party (PDP) legislator Naeem Akhtar Andrabi, Minister of Haj and Auqaf Peerzada Mohammad Syed told the Legislative Council on Monday that 3558.6 kanals of Wakaf Council land have been encroached by government departments, of which 2539.14 kanals were illegally encroached upon by Defence and Army.
Syed also informed the House that Education Department of Jammu province has encroached more than 307 kanals of Wakaf land, followed by Police with 197 kanals and PRO/Evacuee Department with 190 kanals.
Fourteen other government departments, which include some Central and government departments, have encroached upon the Wakaf land properties at different places in the state, the minister said.
He said the matter had been taken up with the concerned for retrieval of property or payment of compensation or rent and occupation charges.
“…the Wakaf properties encroached by the locals and individuals have been retrieved in some places and in other cases the department was processing the eviction proceedings as per the relevant provisions of J&K Wakaf Act 2001,” Syed said.
In another question, Syed said the total area of the dargah of Hazrat Ibrahim Qadri (RA) at Gandhi Nagar land was 74 kanals and six marlas out of which the government had requisitioned 12 kanals and five marlas, leaving the remaining 62 kanals and one marlas with the ziarat.
“The ziarat at Gandhi Nagar along with the Wakaf properties have not been taken over by the Auqaf Islamia Jammu for its management. The matter was dragged by the petitioner (Mujawairs) to Supreme court which passed directions in favour of the Auqaf,” Syed said, adding that the petitioners had again approached High Court.
“The court case is being vigorously followed by Auqaf Islamia Jammu,” the minister added.
