GMC Principal’s extension challenged in HC

Srinagar: Jammu and Kashmir High Court has issued notice to government on a petition challenging recent Cabinet decision regarding one year extension in the service of Dr Rafiq Ahmad Pampori as Principal, Government Medical College Srinagar beyond his date of retirement on superannuation.

The notice, returnable within two weeks, was issued to the respondents by a single bench of Justice Dhiraj Singh Thakur on a petition filed by former Medical Superintendent of Children’s Hospital Dr Javed Chowdhary.

“In the meantime, the extension of (Pampori) shall be subject to the outcome of the writ petition,” the bench said, directing to list the case for further consideration after weeks.

Dr Chowdhary was removed from the post of MS, Children’s Hospital in wake of large scale infant deaths in the hospital nearly two years ago.  He was, however, exonerated by an inquiry commission, as the charges of negligence and corruption against him could not be established.

In his petition, Dr Chowdhary has challenged the extension of Dr Pampori, claiming it to be in violation of the Cabinet decision banning the extension in the services of government employees after retirement.

Dr Chowdhary has also argued that he is the senior most person to head the GMC after the retirement of Dr Pampori who but for the extension would have retired on Friday, February 28.

Respondents in the petition include state through Chief Secretary, Commissioner Secretary Health and Medical Education, Commissioner Secretary GAD, Cabinet Secretary besides Dr Pampori.
