Molestation case: Shabir Khan invokes ‘Indian’ credentials in bail plea

Srinagar: Terming the case of alleged molestation attempt filed against him by a lady doctor as “false and frivolous,” the former Minister of State for Health Shabir Ahmad Khan has invoked his upholding Indian nationalism in the bail plea.
Khan through his counsels headed by senior advocate B S Slathia filed the bail application before Srinagar wing of the High Court which came up for hearing on Monday before a bench of Justice Janak Raj Kotwal.
The court issued notice and directed respondents (government and Station House Officer of police station Shaheed Gunj) to file objections to the bail application, Additional Advocate General, R A Khan, told Kashmir Reader. On asking of the court, the AAG accepted the notice.
“The bail application has been posted for further consideration by the court (on Wednesday),” he added.
The court also declined the request by his lawyer for an interim bail to enable Khan, a senior Congress leader representing assembly from Rajouri constituency, join the Assembly in Budget Session.
In his bail application, Khan has said that he was apprehending arrest at the hands police “in a false and frivolous case registered against him.”
“It is further submitted that the petitioner never succumbed to politics of separatists and always upholds Indian nationalism,” he has said in the petition.
The former minister has also mentioned his participation in three roundtable conferences at New Delhi and Srinagar and nomination as member of first working group of Confidence-Building Measures across different sections of the society.
“The petitioner has neither committed any crime nor has he any knowledge of same. The petitioner has never participated in anti-social activities and earned reputation in society.”
Khan stepped down as MoS Health on Friday last, a day after police registered a case a case FIR (No. 09/2014) under RPC sections of 354 (assault or criminal force to woman with intent to outrage her modesty) and 509 (word, gesture or act intended to insult the modesty of a woman) based on a complaint by the doctor. She has alleged that Khan “acted like a sexual predator” and tried to molest her in his office at winter Secretariat here on January 28.
On Saturday last, Khan had not presented the anticipatory bail before Sessions court despite providing a copy to Public Prosecutor as part of the procedure. On the same day, Chief Judicial Magistrate here had issued arrest warrant against him.
