Srinagar: The High Court on Tuesday issued notice to state government and Principal GMC Saima Rashid challenging her appointment as principal GMC.
The notice was filed after a fresh petition was filed before court on Tuesday challenging her appointment as Principal GMC, Srinagar.
The petition was filed by Dr Javed Choudhary through his counsel SH Thakur before division bench of Justice Ramalingam Sudhakar and Justice Ali Mohammad Magrey.
Advocate SH Thakur submitted before court that the cabinet has made appointment in violation of the government business rules.
He also pleaded before the court that “recommendation of Dr Javed Choudhary’s appointment was made by high level establishment cum selection committee headed by chief secretary but was not approved by cabinet and appointment of Dr Samia was “out of the blue.”
“It is quite unfortunate that a person has been appointed which doesn’t deserve to be holding the present position,” he added.
He said that present GMC principal, Dr Samia Rashid was junior to Dr Javed Choudhary and falls at a serial five in the consideration list for the post of Principal GMC.
“The order of her promotion is void and cannot sustain,” he said.
While admitting the appeal against the present appointment of GMC principal, the court issued notice to state government and Dr Samia.
In April this year, the single bench headed by Justice Alok Aradhe had dismissed the petition on the grounds that the present GMC principal possesses the prescribed qualification and experience.
