Court sentences 4 days jail and Rs 500 fine

Srinagar: A court in Srinagar convicted five persons after their open confession for transporting construction material to the peripheries of Dal Lake.
Carrying construction material to the peripheries of the lake without government  permission is banned.
The court of Chief Judicial magistrate convicted the five persons under section 188 RPC. While passing the order, the court directed the superintendent of Central Jail Srinagar to release the convicted after four days. Court also fined them rupees 500 each.
An FIR (42/2017) was filed against the convicted – Ghulam Qadir Wani, Reyaz Ahmed Wani, Javaid Ahmed Bhat, Fayaz Ahmed Malik and Ishfaq Nazir Malik, all residents of block Fatehpora Ganderbal – on March 29 at Police Station Nigeen for carrying construction material into the prohibited areas of Dal lake.
During the police checking at Habak crossing, the five persons driving their tippers were intercepted by police and were found carrying construction material into the prohibited areas. Their vehicles lacked requisite permissions granted by Lakes and Waterways Development Authority, notes the case dairy.
A PIL was filed in 2002 by Syed Tahir Geelani where High Court took note of transport of construction material to certain areas around Dal Lake and passed orders that permission be sought from LAWDA two days before carrying such material. The court also ordered that office of the SSP Traffic should to be informed and permission sought for carrying such material to these areas.
In a latter hearing, High Court observed, “With great pain, we are persuaded to observe that in case strong commitment in not exhibited and stern action is not taken against the encroachers, out posterity may lose to see world famous water body, Dal Lake”.
