Rechecking of OMR sheet not permissible as per BOPEE instructions: SC

SRINAGAR: The Supreme Court of India has set-aside J&K high court judgment in which it had ordered JK Board of Professional Entrance Examination to re-evaluate OMR answer sheet of a candidate and redraw the MD merit list selection in accordance with merit.
“In view of the instruction under the heading ‘General Information and Instructions of Information Brochure, 2015’, it is clear that the question of re-evaluation/re-checking of the OMR answer sheet is not permissible. Under these circumstances, we set aside the impugned order passed by the High Court,” said a division bench of Justices Madan B. Lokur and Prafulla C. Pant while allowing an appeal filed by the BOPEE.
Counsel for representing Pankaj Sharma, the candidate in whose plea the high court had passed directions to the BOPEE, informed the apex court that his client has already been selected in 2016. “He may want to take some action against the appellants (BOPEE and others) in respect of the year 2015. We make no observation or comment in this regard,” the court said.
Pankaj had sought direction to the BOPEE to re-evaluate her OMR Answer Sheet, Paper-II of MD/MS/PG Diploma and MDS Entrance Test 2015.
Having done MBBS from Government Medical College Jammu, Pankaj had applied for MD/MS/PG Diploma Course in pursuance of Advertisement Notification (No.01-BOPEE of 2015 dated 08.01.2015). Thereafter, she appeared in the examination held on March 15, 2015. She had stated in the plea before the high court that during the second session, she was provided Question Booklet Series “B” with Question Booklet No.520198.
In the OMR Answer Sheet where she had to fill-in the answers, she said, due to oversight and inadvertence, instead of mentioning “B” against the Column of Question Booklet Series, the petitioner filled “A” and proceeded to solve the questions on the OMR Answer Sheet. She said that in the result declared on April 2, 2015 she has been awarded 93 marks in Paper-I, whereas only 34 marks have been awarded to her in Paper-II due to wrongly/inadvertently mentioning as “A” against the column of Question Booklet Series.
Soon after declaration of the result, She approached BOPEE with a request to re-evaluate her OMR Answer Sheet of paper-II after taking Question Booklet Series as “B” instead of “A”. However, BOPEE refused to entertain her request.
