Court finds teacher guilty of raping student

Srinagar: A private teacher was convicted for raping a minor student in a suburban locality more than two years ago. The quantum of punishment would be pronounced on Monday.
“From the close scrutiny of the entire evidence, I come to the inescapable conclusion that the prosecution have been able to prove the charge(s) against the accused by leading clear, cogent, reliable, convincing and dependable evidence beyond any shadow of doubt,” Second Additional District and Sessions Judge, Sham Lal Lalhal said as he convicted the teacher—Pervaiz Ahmad Dar of New Colony Old Barzulla for raping the minor.
Besides finding Dar guilty under section 376 (rape), the court also convicted him under RPC sections of 342 (wrongful confinement) and 506 (criminal intimidation).
The court will pronounce the quantum of punishment after hearing Dar’s counsel as well as prosecution, represented by public prosecutor Ms Jahan Ara, on Monday.
Dar was arrested by police soon after brother of the victim (name withheld) filed a complaint with police station Saddar here on December 12, 2013.
A case (FIR No. 242/2013) was registered and the cops had immediately written a letter L.D Hospital for providing medical treatment to her. Besides a few stitches, one pint of blood was administered to her. Subsequently police after recording statement of witnesses and obtaining medical certificate, a charge sheet was presented against Dar under sections 376, 342 and 506 RPC. The court on February 20, 2014 charged Dar but he denied the allegations and claimed to be tried.
The victim was actually Dar’s erstwhile student. On the day of the occurrence of crime, she had visited Dar’s home to handover an amount of Rs 2000 for a tutor who had taught her. Dar was an acquaintance of the tutor.
“Since Dar was known to the family, they requested him to persuade the tutor to accept the tuition fee of Rs 7000 in installments. On the fateful day, the girl’s mother gave her Rs 2000 to pay him as first installment”, a policeman associated with the case told Kashmir Reader. He said the teacher locked the victim in his room and committed rape on her.
